1. NATURE OF THE SERVICE
TracePath provides a cloud-based SaaS platform for structuring, generating, and hosting Digital Product Passports (DPPs) in alignment with EU Regulation 2024/1781 (ESPR). TracePath is a technical infrastructure provider only — NOT a DPP Service Provider as defined in Article 11 of Regulation (EU) 2024/1781. TracePath records what Users declare and does not verify or audit the accuracy of submitted data.
2. USER RESPONSIBILITIES
The User is solely responsible for the accuracy and legality of all submitted data. By clicking "Publish," the User confirms the data conforms to all applicable regulations (ESPR, EU Battery Regulation, etc.).
3. SUBSCRIPTION AND THE 10-YEAR OBLIGATION
Public QR visibility is conditional upon a valid, active subscription. The EU legal obligation to keep DPP data accessible for 10 years rests exclusively with the User. If payment is 14 days overdue, TracePath reserves the right to suspend public QR visibility.
4. DATA EXPORT AND PORTABILITY
Users may export data in JSON format at any time during an active subscription. Upon termination, a 30-day grace period is provided. After this period, TracePath may permanently delete all data.
5. SECURITY AND AUDIT TRAIL
TracePath records your IP address, precise timestamp, and Terms version accepted during registration and each publication for legal defensibility (GDPR Art. 6(1)(f)).
6. DATA PROTECTION (GDPR)
TracePath acts as Data Processor; the User acts as Data Controller. Audit logs are retained for 10 years to match ESPR traceability requirements.
7. LIMITATION OF LIABILITY
TracePath's total liability is limited to fees paid in the six (6) months preceding the claim. We are not liable for regulatory fines or damages from inaccurate user-submitted data.
8. GOVERNING LAW
This Agreement is governed by the laws of the Republic of Lithuania.
By accepting, you confirm you are the authorized Economic Operator responsible for all submitted data, and that TracePath records your IP address and timestamp for audit integrity purposes.
